This is Harassment

Sound familiar?

"Mary, your job qualifications are fine, but, you need to be really, really nice to me if you want me to hire you as an independent contractor for this job in San Francisco."

Harassment can be based on any protected characteristic, but sexual harassment is the most familiar kind of harassment.

Quid pro quo sexual harassment occurs when an employment benefit is conditioned on sexual favors. Here, Mary's prospective employer has conditioned her hiring as an independent contractor on sexual favors. Mary has a quid pro quo sexual harassment claim.

Hostile work environment sexual harassment occurs when unwelcome sexual advances, touching, blocking, slurs, insults, and/or posting offensive pictures create a hostile work environment. Gulab (see previous page) has a hostile work environment sexual harassment claim because her boss constantly says and does things to disparage and disempower women. His sexual harassment is more about dominance than desire.
